ComicEngine ("the Service") is an interactive serialised-comic publishing pipeline operated by XSoft Damian Kołodziej (NIP 8133862070, REGON 389170574), registered at Nienadówka 373, 36-052, Poland ("we", "us", "Operator").
The Service generates serialised comic episodes using artificial intelligence (large language models and image-generation models) and publishes them on third-party social platforms — currently Instagram, Facebook Pages and TikTok. The Service collects public engagement (comments containing voting emoji) from those platforms and uses the aggregated result to influence the next episode's narrative.
2. Public-facing content vs admin panel
Public users interact with the Service exclusively through the third-party social platforms on which episodes are published (Instagram, Facebook, TikTok). The administrative panel of the Service is restricted to authorised operator personnel and is not made available to the public.
By participating in voting (commenting on a published episode), you agree that your public comment may be retrieved by the Service from the source platform's API and counted toward narrative outcomes. All such retrieval is subject to the respective platform's Terms of Service and Developer Policies.
3. Intellectual property
AI-generated content. Comic episodes, panels, captions and accompanying text are produced by artificial intelligence based on prompts authored by the Operator. To the extent allowed by applicable law and by OpenAI's Terms of Use (the underlying provider for content generation), the Operator claims ownership of and the right to publish such content.
User contributions. Comments and votes submitted on a third-party platform remain subject to that platform's rules. By voting you grant the Operator a non-exclusive, royalty-free licence to retrieve and process your public comment for the limited purpose of operating the voting mechanic. No private messages or non-public data are accessed.
4. Acceptable use
You agree not to: (a) use the Service or its API integrations to harass, defame or harm any person; (b) attempt to reverse-engineer, decompile or otherwise access the admin panel without authorisation; (c) submit votes through automated means designed to manipulate outcomes; (d) violate the Terms of Service of Instagram, Facebook, TikTok or any other connected platform.
5. Disclaimers
The Service is provided "as is" without warranty of any kind. AI-generated content may contain inaccuracies, anachronisms or stylistic anomalies. The Operator does not guarantee uninterrupted availability, error-free operation or specific outcomes from the voting mechanic. The narrative is fictional and does not represent advice of any kind.
6. Limitation of liability
To the maximum extent permitted by Polish law, the Operator's total liability arising out of or relating to the Service is limited to PLN 100. The Operator is not liable for indirect, incidental, special, consequential or punitive damages.
7. Termination
The Operator may suspend or discontinue the Service, in whole or in part, at any time and without prior notice. Discontinuation does not affect rights or obligations accrued prior to the termination.
8. Governing law
These Terms are governed by the laws of the Republic of Poland. Disputes are subject to the jurisdiction of the courts competent for the Operator's registered seat (Rzeszów, Podkarpackie voivodship), to the extent permitted by mandatory consumer-protection rules.
9. Changes
We may revise these Terms from time to time. The effective date above will be updated when changes are made. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
